GenShift Terms of Service
Effective Date: 2 Auugust 2026
These Terms of Service (“Terms”, “Terms of Service”, or “Agreement”) govern the use of services provided by GenShift (“GenShift”, “we”, “us”, or “our”). By ordering, activating, accessing, or using any GenShift service, you (“Customer”, “you”, or “your”) agree to be bound by these Terms.
If you do not agree with these Terms, you must not purchase or use GenShift services.

🚫 Suspension Rules

1. Acceptance of Terms
By creating a GenShift account, placing an order, making a payment, or using any GenShift service, you confirm that you have read, understood, and agreed to these Terms and any applicable service-specific policies.
These Terms apply to all GenShift services unless a separate written agreement specifically states otherwise.
GenShift reserves the right to update these Terms when reasonably necessary. The latest version will be published on the GenShift website.
2. Services
GenShift provides hosting and infrastructure services that may include:
- Web Hosting
- Cloud Hosting
- VPS Hosting
- DMCA-Ignored VPS
- Managed VDS
- Server Licenses
- Domain Registration and Renewal
- Other services offered through the GenShift website or Client Area
Service specifications, resources, features, and limitations depend on the package purchased.
3. Account & KYC Verification
Customers must provide accurate, complete, and current information when creating and maintaining a GenShift account.
Customers are responsible for:
- Maintaining accurate account information.
- Protecting account credentials.
- All activity conducted through their account.
- Immediately reporting suspected unauthorized access.
GenShift may request KYC (Know Your Customer) or identity verification where reasonably necessary, including in connection with:
- Abuse complaints
- Security incidents
- Suspicious or fraudulent activity
- High-risk services
- Payment verification
- Legal or regulatory requirements
- Protection of GenShift infrastructure or other customers
Failure to complete required KYC verification may result in service suspension or termination.
4. Payments & Billing
Customers are responsible for paying all invoices by their applicable due dates.
Invoice Generation
Recurring service invoices are generally generated 7 days before the service due date.
GenShift may send up to three payment reminders regarding an outstanding invoice.
Late Payments
A late payment fee may be applied when an invoice remains unpaid for more than 3 days after its due date.
GenShift may suspend or terminate services because of unpaid invoices.
Outstanding invoices remain payable even after suspension or termination.
If an outstanding balance remains unresolved, GenShift may issue a legal payment notice or pursue appropriate collection or legal remedies where applicable.
5. Cancellation & Refunds
Managed VDS Cancellation
Managed VDS customers must submit a cancellation request at least 31 days before the next applicable billing period.
For a newly purchased Managed VDS during the first month of service, cancellation may be requested with at least 14 days’ notice, subject to the applicable refund terms.
Managed VDS services are non-refundable.
VPS Cancellation
VPS customers must submit a cancellation request at least 7 days before the intended cancellation date.

Refunds may be denied if:
- The service was terminated due to abuse or a Terms violation.
- The customer engaged in prohibited activity.
- Fraudulent activity was identified.
- The refund request is outside the applicable refund period.
- The service has been materially abused or misused.
- The payment relates to a non-refundable service, third-party fee, renewal, or other excluded item.
Cancellation does not automatically cancel outstanding invoices or payment obligations.
6. Acceptable Use & Prohibited Activities
GenShift services must be used lawfully and responsibly.
The following activities are strictly prohibited:
- Phishing
- Malware distribution or hosting
- Botnets
- Spam and unsolicited bulk messaging
- Fraud, scams, or deceptive activities
- Illegal content or illegal activities
- Copyright infringement
- Unauthorized access to systems, networks, accounts, or data
- DDoS attacks or participation in DDoS attacks
- Port scanning, network abuse, or unauthorized security testing
- Cryptocurrency mining where prohibited by the applicable service
- Excessive or abusive resource consumption
- Harassment, threats, or malicious activity
- Child sexual abuse material or exploitation
- Any other activity prohibited by applicable law
This list is not exhaustive. GenShift may take action against any activity that creates or reasonably appears to create a security, operational, legal, reputational, or infrastructure risk.
Customers are responsible for all websites, applications, files, communications, content, and activities operated through their services.
7. Abuse Complaints & Enforcement
GenShift may investigate abuse complaints received from third parties, network providers, security organizations, registries, authorities, or other sources.
When an abuse issue is identified, GenShift may issue an Abuse Notice through the customer’s GenShift Client Area. The notice may also be displayed in the Client Area sidebar.
An Abuse Notice may contain:
- Details of the reported activity
- Affected service
- Required corrective action
- Response deadline
- Applicable fee, if any
- Additional requirements
Customer Response
Unless a different deadline is specified in the notice, customers must respond to the Abuse Notice and take appropriate corrective action within 24 hours.
Depending on the incident, corrective action may include removing content, disabling an application, securing a compromised account, stopping abusive traffic, fixing a vulnerability, or providing requested information.
Abuse Fees
GenShift may apply an abuse or administrative fee based on the nature, severity, impact, investigation requirements, and recurrence of the violation.
The amount of any applicable fee may vary depending on the circumstances.
Repeated Violations
If the same or substantially similar violation occurs again, GenShift may issue an additional fee and take stronger enforcement action.
After three violations, GenShift may terminate the affected service or account if the customer continues to violate these Terms or fails to adequately resolve the issue.
For severe abuse, illegal activity, active attacks, serious security threats, or circumstances that create an immediate risk, GenShift may suspend or terminate the service without waiting for the progressive enforcement process.
Failure to respond to an Abuse Notice may itself constitute a violation.
8. Resource Usage
Customers must use service resources reasonably and within the limits of their purchased plan.
Resource abuse may include:
- Excessive CPU usage
- Excessive RAM usage
- Excessive disk I/O
- Excessive processes
- Excessive inode usage
- Excessive database activity
- Excessive network usage
- Activities negatively affecting other customers
- Attempts to bypass technical limitations
GenShift may require customers to optimize, reduce, migrate, or modify resource-intensive applications.
If resource usage creates a significant operational or security problem, GenShift may restrict, suspend, or terminate the affected service.
9. VPS, DMCA-Ignored VPS & Managed VDS
VPS Services
Customers using unmanaged VPS services are responsible for the administration and security of their VPS, including:
- Operating system
- Software updates
- Applications
- Firewall
- User accounts
- Passwords
- Installed software
- Websites and applications
- Stored data
DMCA-Ignored VPS
“DMCA-Ignored” does not mean unrestricted or illegal activity is permitted.
DMCA-related handling may differ depending on the applicable service and infrastructure, but customers must still comply with these Terms and may not use the service for malware, phishing, fraud, hacking, DDoS attacks, or other prohibited activities.
Managed VDS
Managed VDS includes server management assistance according to the purchased service scope.
Depending on the service, management may include server administration, configuration, troubleshooting, updates, optimization, security assistance, and related server-management tasks.
Managed service does not include unlimited development, custom software development, or guaranteed compatibility with every third-party application.
Customers remain responsible for:
- Website/application code
- Customer-generated content
- Third-party software licensing
- Application-level issues outside the management scope
- Maintaining independent backups
- The legality of their hosted content and activities
GenShift may refuse requests that are outside the purchased management scope, create unreasonable security risks, violate these Terms, or require unsupported third-party software.
10. Domain Registration, Renewal & Redemption
Domain registrations and renewals are subject to applicable registry, registrar, and domain authority policies.
Customers are responsible for:
- Providing accurate registration information.
- Renewing domains before expiration.
- Maintaining access to the registered contact information.
- Complying with applicable domain policies.
Where applicable, GenShift provides a 30-day grace period after domain expiration.
A domain entering redemption may require a $150 redemption fee, in addition to applicable renewal or registration charges.
Restoration of an expired or deleted domain is not guaranteed where the applicable registry or registrar does not permit restoration.
Domain registration and renewal fees are generally non-refundable once the registration or renewal has been processed, subject to applicable registry/registrar policies and law.
11. Backups & Data
GenShift provides backups for applicable hosting plans.
Backups are provided as a recovery measure and are not a substitute for maintaining independent backups.
Customers remain responsible for maintaining copies of important or critical data.
After service termination, customers may request an available backup where technically possible.
A $10 backup retrieval/restoration fee may apply after service termination.
GenShift does not guarantee that every backup will always be available, complete, or restorable.
12. Uptime & Maintenance
GenShift targets 99.9% uptime for applicable services.
The uptime target may exclude downtime caused by circumstances outside GenShift’s reasonable control, including:
- Scheduled maintenance
- Emergency maintenance
- Customer configuration
- Customer applications
- DDoS attacks
- Third-party network failures
- Datacenter or upstream provider failures
- Internet infrastructure failures
- Government actions
- Force majeure events
- Other circumstances outside GenShift’s reasonable control
13. Suspension & Termination
GenShift may suspend or terminate a service or account for reasons including:
- Non-payment
- Abuse
- AUP violations
- Security threats
- Fraud
- Excessive resource usage
- Failure to complete required KYC
- Repeated violations
- Illegal activity
- False or misleading account information
- Attempts to bypass service restrictions
- Conduct that threatens GenShift infrastructure or other customers
Where appropriate, GenShift may provide notice before suspension or termination.
However, immediate action may be taken when necessary to prevent ongoing abuse, security threats, illegal activity, infrastructure damage, or other serious harm.
No Refund After Abuse Termination
If a service or account is terminated because of abuse, prohibited activity, fraud, illegal activity, security abuse, or another serious violation of these Terms, no refund will be provided.
Following termination, access to the service may be disabled immediately.
Customer data may be deleted after the applicable retention period. Customers are responsible for retrieving their data before termination whenever possible.
14. Customer Content & Intellectual Property
Customers remain responsible for all content, websites, applications, files, databases, software, and other material stored or operated through GenShift services.
Customers represent that they have the necessary rights, permissions, and licenses to use and host their content.
The GenShift name, logo, website design, branding, documentation, and other GenShift intellectual property may not be copied, reproduced, modified, or commercially exploited without authorization.
15. Security & Third-Party Services
Customers are responsible for maintaining reasonable security of their services.
This includes:
- Using strong passwords
- Applying security updates
- Securing applications
- Protecting administrative accounts
- Monitoring suspicious activity
- Maintaining appropriate security controls
Customers must not use GenShift infrastructure to attack, compromise, scan, or gain unauthorized access to third-party systems.
Some GenShift services rely on third-party providers, including datacenters, registries, software providers, control panels, licensing providers, network providers, and payment processors.
Third-party services may have separate terms and policies. GenShift is not responsible for changes, outages, restrictions, or failures caused by third parties outside GenShift’s reasonable control.
16. Limitation of Liability & Indemnification
To the maximum extent permitted by applicable law, GenShift will not be liable for indirect, incidental, special, consequential, or punitive losses, including loss of profits, revenue, business opportunities, reputation, or data arising from the use or inability to use GenShift services.
GenShift is not responsible for losses resulting from:
- Customer actions
- Customer software or configuration
- Customer security failures
- Third-party services
- Network failures outside GenShift’s control
- DDoS attacks
- Force majeure events
- Compromised customer credentials
Customers agree, to the maximum extent permitted by applicable law, to indemnify and hold GenShift harmless from claims, losses, damages, liabilities, costs, and reasonable expenses arising from:
- Customer content
- Customer applications
- Violation of these Terms
- Violation of applicable law
- Infringement of third-party rights
- Misuse of GenShift services
Nothing in these Terms excludes liability that cannot legally be excluded.
