Backup & Data Responsibility Policy: GenShift

This policy outlines the backup procedures and data management responsibilities at GenShift. Our goal is to provide clear expectations regarding data safety. In short: Your data is valuable, and while we provide tools to help, the primary responsibility for protection lies with you.
1. Primary Data Responsibility
Ownership: All files, databases, emails, and applications stored on your account belong to you.
Management: You are responsible for the content you upload, modify, or delete.
Role of GenShift: GenShift acts as the infrastructure provider. We are not your personal storage or data manager.
Liability: GenShift is not automatically responsible for data loss caused by user error, hacking, or software glitches.
2. Backup Nature & Limitations
GenShift may provide backups as a value-added safety feature, but please note:
No Guarantees: Backups are provided as a convenience, not a contractual promise.
Not Real-Time: Backup snapshots are taken periodically; they do not capture real-time changes.
Technical Failures: Occasionally, backups may fail, be incomplete, or become corrupted due to technical constraints.
3. Mandatory Off-Site Backups
To ensure maximum data security, we strongly recommend that all customers:
Regular Downloads: Manually download backups of your website and databases.
Off-Site Storage: Keep copies of your data outside of your GenShift hosting account (e.g., local drive or cloud storage).
Restoration Testing: Periodically test your backups to ensure they are functional.
Note: Relying solely on hosting provider backups is a high-risk strategy and is not advised.
4. Data Restoration Requests
If you require a backup restoration and one is available:
Best-Effort Basis: Restores are performed to the best of our technical ability.
No Time Guarantee: Restoration time varies depending on data size and server load.
System Integrity: GenShift reserves the right to refuse a restore if it poses a risk to server stability or security.
5. Access During Suspension & Termination
Access to backups during account issues is handled as follows:
Standard Issues: For minor violations (e.g., copyright or spam), backups may be provided if available.
Serious Violations: For accounts involved in scams, phishing, fraud, or malware, backup access will be denied.
Permanent Removal: Data linked to illegal activities may be purged immediately without the possibility of recovery.
6. Limitation of Liability
GenShift shall not be held liable for:
Loss of files, databases, or corrupted data.
Business losses or “loss of profits” resulting from missing data.
Inability to recover data even if a backup exists.
7. Customer Best Practices
To minimize risks, we advise all users to:
Maintain regular off-site backups.
Use strong passwords and Two-Factor Authentication (2FA).
Keep all software, scripts, and plugins updated.
Monitor account activity for any unauthorized changes.
8. Policy Update
GenShift reserves the right to update this policy at any time. Your continued use of our Services constitutes acceptance of the most recent version of this policy.
